Standards Commission of Labour (CNT) claims on behalf of an employee, wages and allowances for public holidays and annual Conde. The defendants have acknowledged some of the amounts claimed but require that compensation be made between the two claims.
The Court of Quebec decision on the claim of the CNT based on the credible testimony of the employee and the notes she has recorded in his diary on a daily basis. The defendants did not maintain records of hours worked, as required by law. Moreover, their testimony at the hearing was vague and often inconsistent with the documents they have produced. But we must give more probative value the testimony of the employee to the employer when the latter has violated the law. Therefore, the claim is established. J.E. 2011-1925 |
