| Legal duties of a financial planner |

A financial planner has a duty to provide advice to his clients. He must inform them adequately about the nature, performance and risk that their titles suggest. The financial planner must assess the knowledge of his client's investment and establish a specific profile to properly advise his client in their investments. The Superior Court determined that a financial advisor has a duty to advise and can be held at fault when there is a breach of that duty to the client and is incurs financial losses due to his advice.
