Before the death of his mother, July 19, 2007, the defendant had a procuration for her to look after her property. The defendant paid $ 740 in the bank account of his mother for the funeral, but she never paid the balance due. As a result, the plaintiff claimed $ 5,111 to it and the estate.
The Court of Quebec to decide between that section 642 of the Civil Code of Québec provides that the conservatory acts do not entail tacit acceptance of the estate. An appeal against the estate must therefore be rejected. However, the defendant had contracted to pay this fee by signing the contract, jointly with her sister; she must pay the balance owed to the plaintiff. J.E. 2011-1955 |
